1. Definitions

Service — the SwapMyTech trade-up marketplace. New Product — a device available on /shop. Old Device — the device you offer in trade. Rough Estimate — the non-binding range shown after the valuation wizard. Verified Value — the binding value set by a field agent on-site. Price Difference — New Product price minus Verified Value, computed server-side. Field Agent — a SwapMyTech operator who visits you. Visit — the on-site verification. Order — your free placement at /swap/checkout. Guest Tracking Link — a signed, expiring URL to follow an order without signing in. DPDP Act — Digital Personal Data Protection Act, 2023. Data Fiduciary — SwapMyTech, in DPDP terms.

2. Who we are

SWAP MY TECH E-SOLUTIONS PRIVATE LIMITED, registered at Bengaluru, Karnataka, India – 560013. Contact support@swapmytech.com. Use of the Service requires you to be 18+, legally able to contract, and the rightful owner of the Old Device with clear title.

3. The trade-up model

The funnel is: free order → visit scheduled → verified → payment link → paid → procuring → delivered. Order placement and the field visit are free. Target fulfilment after payment is 48 hours; this is a goal, not a guarantee.

4. Valuation is non-binding until verified

Nothing displayed during the quote wizard is an offer. The on-screen number is a range; the only binding value is the Verified Value set by the agent on-site. The agent may move the Verified Value by up to ±10% from the Rough Estimate, with a logged reason. Any adjustment outside that range is system-blocked.

5. The field visit & consent

By placing an order you authorise an agent to visit the address you provide, request consent to inspect the Old Device, and conduct mutual ID verification. SwapMyTech agents carry company ID; please verify before granting entry. You may refuse entry at any time; the order is then cancelled at no charge.

6. Your warranties about the Old Device

You warrant: you legally own the device; it is not stolen, lost, IMEI-blacklisted, or encumbered; all locks (Find My iPhone, Activation Lock, Google FRP, MDM) are removed; your personal data is wiped or will be wiped before handover (we are not liable for data left on the device); known faults are disclosed honestly. Material misrepresentation lets us revise the Verified Value within the guardrail or cancel the swap.

7. Title transfer & resale

On accepted handover, title to the Old Device passes to SwapMyTech. We may resell it. After handover you cannot reclaim it except per Refund Policy.

8. Payment

The Price Difference is always computed server-side from the Verified Value; we never trust an amount from your browser. Payment is made via the official Razorpay link sent to you after verification — we never request card numbers, CVV, UPI PINs, or OTPs by phone, WhatsApp, or email. Ignore any payment request not originating from a Razorpay link tied to your order.

See Refund & Cancellation Policy. Cancellation windows differ by funnel stage.

10. Service area & timelines

Service is limited to Bengaluru at launch. Feasibility is triaged manually per address.

11. Acceptable use

No bots or automated scraping of the quote or order forms; no fraudulent valuations; one account per person.

12. Accounts & guest tracking

You may sign in with Google or use guest tracking. Guest tracking links are signed and expire; anyone with the link can view order status — do not share it.

13. Limitation of liability

Our aggregate liability for any claim arising from a single Order is capped at the value of that Order. Your non-waivable statutory rights under the Consumer Protection Act, 2019 are preserved.

14. Grievance redressal

15. Governing law & jurisdiction

Laws of India; courts at Bengaluru, Karnataka.

Material changes are notified by email or an in-site banner; check the “Last updated” date above.
